Cher Monsieur,

Le 15 décembre 2022, nous vous faisions part du risque que représente, pour des organisations, le fait d’avoir recours aux prestations du navire russe « Shtandart ».

Nous souhaitons vous préciser que M. Michel Balique, Président de l’association des « Amis des Grands Voiliers », se faisant l’agent commercial du « Shtandart », se trompe quand il vous dit que les sanctions ne concernent que les navires des oligarques ou de l’Etat russe, voire les navires militaires. Il s’en tient aux mesures prises avant la fin mars 2022. C’est-à-dire avant les révélations concernant les crimes de Boutcha, Irpin, Marioupol, etc.

1.  Il est interdit de donner accès, après le 16 avril 2022, aux ports et, après le 29 juillet 2022, aux écluses situées sur le territoire de l’Union à tout navire immatriculé sous pavillon russe, à l’exception de l’accès aux écluses pour quitter le territoire de l’Union

Il est vrai que jusqu’à une date récente, en France, des cas de contournement des sanctions ont été observés concernant le « Shtandart ». Cette pratique du fait accompli ne peut pas faire jurisprudence. En effet, le 28 novembre 2022, le Conseil a adopté à l’unanimité une décision visant à ajouter la violation des sanctions à la liste des domaines de criminalité figurant dans le traité sur le fonctionnement de l’Union européenne (article 83, paragraphe 1). Le contournement des sanctions vient rejoindre « le terrorisme, la traite des êtres humains et l’exploitation sexuelle des femmes et des enfants, le trafic illicite de drogues, le trafic illicite d’armes, le blanchiment d’argent, la corruption, la contrefaçon de moyens de paiement, la criminalité informatique et la criminalité organisée ».

Il nous semble donc judicieux, pour « L’Armada de la Liberté », d’attendre la fin de la guerre en Ukraine avant d’employer les services du navire russe « Shtandart ». D’ici là, si ce dernier ne souhaite pas retourner en Russie, il peut visiter, en toute légalité, les très nombreux pays maritimes qui n’appliquent pas de sanctions.

Objet: Armada de Rouen: le navire Shtandart entre dans le champ du cinquième volet de sanctions interdisant l’entrée des navires russes dans les ports européens.

Cher Monsieur,

Faisant suite à une brève conversation, ce jour, avec votre service de communication, nous vous faisons part des éléments suivants.

Nous avons appris que vous prévoyez de faire appel aux services de la frégate russe Shtandart pour votre prochain événement « l’Armada de la liberté » devant se tenir du 8 au 18 juin 2023. Nous pensons qu’il s’agit d’une décision inopportune et financièrement risquée. En effet, nous nous permettons de vous signaler que le Shtandart entre dans le champ du 5e paquet de sanctions voté, le 8 avril 2022, à l’unanimité des Etats membres de l’Union Européenne. Ce texte prévoit :

-une interdiction de donner accès aux ports de l’UE aux navires immatriculés sous pavillon russe. Des dérogations sont accordées pour les produits agricoles et alimentaires, l’aide humanitaire et l’énergie.

Vous pouvez observer que, contrairement à ce qu’affirment Michel Balique, président de l’Association des « Amis des Grands Voiliers », Jean-François Fountaine, Maire de La Rochelle, et Nicolas Basselier, préfet de Charente-Maritime, le cinquième volet de sanctions ne concerne pas que « certaines catégories de navires », voire seulement les navires des « oligarques » ou ceux de « l’Etat russe ».

Notre collectif a manifesté le 11 décembre 2022 à La Rochelle pour demander la fin de la présence illégale du navire russe dans ce port et pour obtenir l’application effective du cinquième volet des sanctions. Avant même l’adoption des sanctions, Fabrice Loher, maire de Lorient, a décidé que le Shtandart ne serait pas présent au festival « Lorient Océans », car « on ne connaît pas la nature de ses liens avec l’Etat russe ». Nous y reviendrons. Depuis la mise en place du 5eme volet des sanctions, la municipalité de Bordeaux a annulé la participation du navire au festival « Bordeaux Fête Le vin », alors que la prestation du navire russe avait déjà fait l’objet d’un règlement financier. Il en a probablement été de même en ce qui concerne « Escales à Sète », pour laquelle l’interdiction a été émise par le préfet de l’Hérault.

L’annulation de la participation du Shtandart à la « Ruta Iacobus Maris » de Vigo a été prononcée la veille de son arrivée dans ce port à la suite d’un courrier adressé à différentes autorités, dont la Junta de Galicia, par une quarantaine d’organisations représentatives de la diaspora ukrainienne en Espagne et en France, à la suite des révélations « d’El Faro de Vigo », https://bit.ly/faro-de-vigo-shtandart-sanctions-fr, et à la suite d’une manifestation de la communauté ukrainienne de Vigo. En conséquence de quoi, l’escale à la Corogne a elle aussi été annulée. Le sort du Shtandart en Espagne a été scellé par une tribune que nous avons fait paraître dans « Galici@Press » https://www.galiciapress.es/articulo/opinion/2022-07-31/3843303-fabula-anti-putin-permitio-fragata-rusa-shtandart-atracar-galicia (Es).

Aujourd’hui, seuls quelques ports français en Europe sont dans l’illégalité en ce qui concerne l’application des sanctions portant sur les navires russes, dont La Rochelle, où les réseaux d’influence russes sont solidement implantés, au sein des autorités locales et départementales ainsi que dans la presse régionale.

A ce titre, nous attirons votre attention  sur la « fable du Shtandart», qui vise à tromper l’opinion publique française. En consultant des sources russes, nous avons déterminé que le Shtandart est un yacht russe privé appartenant, pour 60%, à Vladimir Martus, son capitaine, via une entité écran nommée « Shtandart Project ». Nous avons mis au jour le fait que le Shtandart et son capitaine entretiennent des liens étroits avec le pouvoir russe. À titre d’exemple, nous mentionnerons une mission de représentation diplomatique tenue par le Shtandart, en octobre 2021, sous le haut patronage de Vladimir Poutine. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). Il s’agissait de la célébration du 250e anniversaire de la victoire navale de Tchesmé en mer Égée. L’événement s’est déroulé en présence des autorités grecques et de l’ambassadeur plénipotentiaire de Russie en Grèce.

En conséquence, Vladimir Martus n’est pas ce qu’il prétend être, c’est-à-dire « un opposant politique de longue date au régime de Poutine ». De même, son affirmation comme quoi il « n’a pas pu revoir son pays depuis de nombreuses années » est inexacte. En ce sens, nous soulignons que le propriétaire du Shtandart est retourné à son domicile de Saint-Pétersbourg entre le début janvier 2022 et la mi-février 2022 https://vk.com/wall354135_3640 (Ru). Enfin, la qualification de « voilier école », que les autorités rochelaises lui attribuent, de façon très contestable, ne change rien à cette affaire. Il n’existe pas d’exception au cinquième volet des sanctions pour les navires-écoles, pas plus qu’il n’en existerait pour les prétentions, même si certaines étaient avérées, de ce qu’il convient d’appeler « la fable du Shtandart ».

5 грудня 2022 року ми повідомляли вам, який ризик для організацій становить користування послугами російського судна « Штандарт ».

Хочемо нагадати вам, що пан Мішель Балік, президент асоціації « Амі ди Гран Вуальє » (Amis des Grands Voiliers), який виступає як комерційний агент « Штандарту », помиляється, коли каже, що санкції стосуються тільки суден що належать олігархам або російській державі, і навіть воєнних суден. Він спирається на заходи, які були чинними на кінець березня 2022 року. Тобто до того, як стало відомо про злочини в Бучі, Ірпені, Маріуполі тощо.

З 8 квітня 2022 року Регламент ЄС N° 833/2014 було оновлено Статтею 3ea, частина шоста, пункт два, https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02014R0833-20221007 (En), до виконання п’ятого пакета санкцій https://www.consilium.europa.eu/en/press/press-releases/2022/04/08/eu-adopts-fifth-round-of-sanctions-against-russia-over-its-military-aggression-against-ukraine/ (En).

1. З 16 квітня 2022 року забороняється надавати доступ до портів, а з 29 липня 2022 року – і до шлюзів, розташованих на території Союзу будь-якому судну зареєстрованому під російським прапором, за винятком доступу до шлюзів для того, щоб покинути територію Союзу

Це правда, що до останнього часу у Франції спостерігались випадки обходу санкцій стосовно судна « Штандарт ». Ця практика доведеного факту не може служити прецедентним правом. Слід зазначити, що 28 листопада 2022 року, Рада Європейського Союзу одностайно ухвалила рішення, яке додає порушення санкцій до списку кримінальних правопорушень, що фігурують в Договорі про функціонування Європейського Союзу (стаття 83, параграф 1). Обхід санкцій долучається до « тероризму, торгівлі людьми, сексуальних зловживань щодо жінок і дітей, незаконної торгівлі наркотичними речовинами, незаконної торгівлі зброєю, відмивання грошей, корупції, підробки платіжних засобів, кіберзлочинності та організованої злочинності ». https://www.consilium.europa.eu/en/press/press-releases/2022/11/28/sanctions-council-adds-the-violation-of-restrictive-measures-to-the-list-of-eu-crimes/ (En)

Таким чином, нам здається більш доцільним для заходу « Лармада Руан 2023 » (Fn) дочекатися кінця війни в Україні, перш ніж користатися послугами російського судна « Штандарт ». Якщо це судно не бажає повертатися в Росію, воно може вже зараз цілком легально відвідувати численні морські країни, які не вживають санкцій.

Розраховуючи на громадську позицію організаторів « Лармада Руан 2023 – Ле Вуаль де ла Ліберте », ми щиро вітаємо вас із Новим роком та зичимо успіху вашому заходу.

Objet: Armada de Rouen: le navire Shtandart entre dans le champ du cinquième volet de sanctions interdisant l’entrée des navires russes dans les ports européens.

Cher Monsieur,

Faisant suite à une brève conversation, ce jour, avec votre service de communication, nous vous faisons part des éléments suivants.

Nous avons appris que vous prévoyez de faire appel aux services de la frégate russe Shtandart pour votre prochain événement « l’Armada de la liberté » devant se tenir du 8 au 18 juin 2023. Nous pensons qu’il s’agit d’une décision inopportune et financièrement risquée. En effet, nous nous permettons de vous signaler que le Shtandart entre dans le champ du 5e paquet de sanctions voté, le 8 avril 2022, à l’unanimité des Etats membres de l’Union Européenne. Ce texte prévoit :

-une interdiction de donner accès aux ports de l’UE aux navires immatriculés sous pavillon russe. Des dérogations sont accordées pour les produits agricoles et alimentaires, l’aide humanitaire et l’énergie.

Vous pouvez observer que, contrairement à ce qu’affirment Michel Balique, président de l’Association des « Amis des Grands Voiliers », Jean-François Fountaine, Maire de La Rochelle, et Nicolas Basselier, préfet de Charente-Maritime, le cinquième volet de sanctions ne concerne pas que « certaines catégories de navires », voire seulement les navires des « oligarques » ou ceux de « l’Etat russe ».

Notre collectif a manifesté le 11 décembre 2022 à La Rochelle pour demander la fin de la présence illégale du navire russe dans ce port et pour obtenir l’application effective du cinquième volet des sanctions. Avant même l’adoption des sanctions, Fabrice Loher, maire de Lorient, a décidé que le Shtandart ne serait pas présent au festival « Lorient Océans », car « on ne connaît pas la nature de ses liens avec l’Etat russe ». Nous y reviendrons. Depuis la mise en place du 5eme volet des sanctions, la municipalité de Bordeaux a annulé la participation du navire au festival « Bordeaux Fête Le vin », alors que la prestation du navire russe avait déjà fait l’objet d’un règlement financier. Il en a probablement été de même en ce qui concerne « Escales à Sète », pour laquelle l’interdiction a été émise par le préfet de l’Hérault.

L’annulation de la participation du Shtandart à la « Ruta Iacobus Maris » de Vigo a été prononcée la veille de son arrivée dans ce port à la suite d’un courrier adressé à différentes autorités, dont la Junta de Galicia, par une quarantaine d’organisations représentatives de la diaspora ukrainienne en Espagne et en France, à la suite des révélations « d’El Faro de Vigo », https://bit.ly/faro-de-vigo-shtandart-sanctions-fr, et à la suite d’une manifestation de la communauté ukrainienne de Vigo. En conséquence de quoi, l’escale à la Corogne a elle aussi été annulée. Le sort du Shtandart en Espagne a été scellé par une tribune que nous avons fait paraître dans « Galici@Press » https://www.galiciapress.es/articulo/opinion/2022-07-31/3843303-fabula-anti-putin-permitio-fragata-rusa-shtandart-atracar-galicia (Es).

Aujourd’hui, seuls quelques ports français en Europe sont dans l’illégalité en ce qui concerne l’application des sanctions portant sur les navires russes, dont La Rochelle, où les réseaux d’influence russes sont solidement implantés, au sein des autorités locales et départementales ainsi que dans la presse régionale.

A ce titre, nous attirons votre attention  sur la « fable du Shtandart», qui vise à tromper l’opinion publique française. En consultant des sources russes, nous avons déterminé que le Shtandart est un yacht russe privé appartenant, pour 60%, à Vladimir Martus, son capitaine, via une entité écran nommée « Shtandart Project ». Nous avons mis au jour le fait que le Shtandart et son capitaine entretiennent des liens étroits avec le pouvoir russe. À titre d’exemple, nous mentionnerons une mission de représentation diplomatique tenue par le Shtandart, en octobre 2021, sous le haut patronage de Vladimir Poutine. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). Il s’agissait de la célébration du 250e anniversaire de la victoire navale de Tchesmé en mer Égée. L’événement s’est déroulé en présence des autorités grecques et de l’ambassadeur plénipotentiaire de Russie en Grèce.

En conséquence, Vladimir Martus n’est pas ce qu’il prétend être, c’est-à-dire « un opposant politique de longue date au régime de Poutine ». De même, son affirmation comme quoi il « n’a pas pu revoir son pays depuis de nombreuses années » est inexacte. En ce sens, nous soulignons que le propriétaire du Shtandart est retourné à son domicile de Saint-Pétersbourg entre le début janvier 2022 et la mi-février 2022 https://vk.com/wall354135_3640 (Ru). Enfin, la qualification de « voilier école », que les autorités rochelaises lui attribuent, de façon très contestable, ne change rien à cette affaire. Il n’existe pas d’exception au cinquième volet des sanctions pour les navires-écoles, pas plus qu’il n’en existerait pour les prétentions, même si certaines étaient avérées, de ce qu’il convient d’appeler « la fable du Shtandart ».

Subject: Rouen Armada, the ship « Shtandart » falls within the scope of the fifth round of sanctions prohibiting the entry of Russian ships into European ports.

Dear Sir,

Following a brief conversation today with your communications department, we would like to inform you of the following.

We have learned that you plan to use the services of the Russian frigate Shtandart for your next « Rouen Armada » event to be held June 8-18, 2023. We believe this is a decision untimely and financially risky. Indeed, we take the liberty of informing you that the « Shtandart » falls within the scope of the 5th package of sanctions unanimously voted by the Member States of the European Union, on April 8, 2022, . This text provides:

a ban on giving access to EU ports to vessels registered under the Russian flag. Derogations are granted for agricultural and food products, humanitarian aid and energy.

You can observe that, contrary to what Michel Balique, president of the Association of « Friends of Tall Ships », Jean-François Fountaine, mayor of La Rochelle, and Nicolas Basselier, prefect of Charente-Maritime, claim, the fifth part of sanctions does not concern only « certain categories of vessels », or even only the vessels of the « oligarchs » or those of the « Russian State ».

Our committee demonstrated on December 11, 2022 in La Rochelle to demand an end to the illegal presence of the Russian ship in this port and to obtain the effective application of the fifth part of the sanctions. Even before the adoption of the sanctions, Fabrice Loher, mayor of Lorient, decided that the Shtandart would not be present at the « Lorient Oceans » festival, because « we do not know the nature of its links with the Russian state ». We will come back to it. Since the implementation of the 5th package of sanctions, the municipality of Bordeaux has canceled the participation of the ship in the festival « Bordeaux Fête Le vin », while the service of the Russian ship had already been the subject of a financial settlement. It was probably the same with regard to « Escales à Sète », for which the ban was issued by the prefect of Herault.

The cancellation of the participation of the Shtandart in the « Ruta Iacobus Maris » of Vigo was pronounced the day before its arrival in this port following a letter sent to various authorities, including the Junta de Galicia, by about forty representative organizations of the Ukrainian diaspora in Spain and France, following the revelations of « El Faro de Vigo » https://bit.ly/shtandart-el-faro-vigo-en and following a demonstration by the Ukrainian community in Vigo. As a result, the stopover in La Coruña was also cancelled. The fate of the Shtandart in Spain was sealed by a column that we published in « Galici@Press » https://www.galiciapress.es/articulo/opinion/2022-07-31/3843303-fabula-anti-putin -permitio-fragata-rusa-shtandart-atracar-galicia (Es).

Today, only a few French ports in Europe are illegal with regard to the application of sanctions relating to Russian ships, including La Rochelle, where Russian influence networks are firmly established, within local and departmental authorities, as well as in the regional press.

As such, we draw your attention to the « Shtandart’s tale », which aims to deceive French public opinion. By consulting Russian sources, we have determined that « Shtandart » is a private Russian yacht owned, for 60%, by Vladimir Martus, its captain, through a screen entity called “Shtandart Project”. We brought to light the fact that « Shtandart » and its captain maintain close ties with the Russian authorities. By way of example, we will mention a diplomatic representation mission held by the Shtandart, in October 2021, under the high patronage of Vladimir Putin. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). It was the celebration of the 250th anniversary of the naval victory of Çeşme in the Aegean Sea. The event took place in the presence of the Greek authorities and the Plenipotentiary Ambassador of Russia to Greece.

As a result, Vladimir Martus is not what he claims to be, that is, “a long-time political opponent of Putin’s regime”. Likewise, his assertion that he « has not been able to see his country again for many years » is inaccurate. In this sense, we point out that the owner of the Shtandart returned to his home in Saint Petersburg between the beginning of January 2022 and mid-February 2022 https://vk.com/wall354135_3640 (Ru). Eventually, the qualification of « training-ship », which the authorities of La Rochelle attribute to it, in a very questionable way, does not change anything in this case. There is no exception to the fifth part of the sanctions for training ships, any more than there would be for the claims, even if some were proven, of what should be called « the Shtandart’s tale » .

Our committee would like to receive a response from your services within a week. In the meantime, we are at your disposal to provide you with the verified information we have about the Russian ship, « Shtandart », and the Russian citizen, Vladimir Martus.

Dear Sir,

On December 15, 2022, we informed you of the risk faced by French organizations using the services of the Russian ship « Shtandart ».

We would like to point out to you that Mr. Michel Balique, President of « Les Amis des Grands Voiliers – Sail Training Association France », acting as the commercial agent of « Shtandart », is mistaken when he tells you that sanctions only concern the ships belonging to the oligarchs and to the Russian state, or even being military ships. He sticks to the measures taken before the end of March 2022. That is before the evidences of the crimes in Bucha, Irpin, Mariupol, etc.

1. It shall be prohibited to provide access, after 16 April 2022, to ports and, after 29 July 2022, to locks in the territory of the Union, to any vessel registered under the flag of Russia, with the exception of access to locks for the purpose of leaving the territory of the Union.

It is true that until recently, in France, cases of circumvention of sanctions were observed concerning the Russian ship « Shtandart ». This practice of the « fait accompli » cannot set a precedent. Indeed, on 28 November 2022, the Council unanimously adopted a decision to add the violation of restrictive measures to the list of ‘EU crimes’ included in the Article 83(1) of the Treaty on the Functioning of the EU. Our committee demonstrated on December 11, 2022 in La Rochelle to demand an end to the illegal presence of the Russian ship in this port and to obtain the effective application of the fifth part of the sanctions. Even before the adoption of the sanctions, Fabrice Loher, mayor of Lorient, decided that the Shtandart would not be present at the « Lorient Oceans » festival, because « we do not know the nature of its links with the Russian state ». We will come back to it. Since the implementation of the 5th package of sanctions, the municipality of Bordeaux has canceled the participation of the ship in the festival « Bordeaux Fête Le vin », while the service of the Russian ship had already been the subject of a financial settlement. It was probably the same with regard to « Escales à Sète », for which the ban was issued by the prefect of Herault.

The cancellation of the participation of the Shtandart in the « Ruta Iacobus Maris » of Vigo was pronounced the day before its arrival in this port following a letter sent to various authorities, including the Junta de Galicia, by about forty representative organizations of the Ukrainian diaspora in Spain and France, following the revelations of « El Faro de Vigo » https://bit.ly/shtandart-el-faro-vigo-en and following a demonstration by the Ukrainian community in Vigo. As a result, the stopover in La Coruña was also cancelled. Today, only a few French ports in Europe are illegal with regard to the application of sanctions relating to Russian ships, including La Rochelle, where Russian influence networks are firmly established, within local and departmental authorities, as well as in the regional press.

As such, we draw your attention to the « Shtandart’s tale », which aims to deceive French public opinion. By consulting Russian sources, we have determined that « Shtandart » is a private Russian yacht owned, for 60%, by Vladimir Martus, its captain, through a screen entity called “Shtandart Project”. We brought to light the fact that « Shtandart » and its captain maintain close ties with the Russian authorities. By way of example, we will mention a diplomatic representation mission held by the Shtandart, in October 2021, under the high patronage of Vladimir Putin. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). It was the celebration of the 250th anniversary of the naval victory of Çeşme in the Aegean Sea. The event took place in the presence of the Greek authorities and the Plenipotentiary Ambassador of Russia to Greece.

As a result, Vladimir Martus is not what he claims to be, that is, “a long-time political opponent of Putin’s regime”. Likewise, his assertion that he « has not been able to see his country again for many years » is inaccurate. Subject: reminder of the European regulation concerning the prohibition of Russian ships in French ports

Dear Madam,

On December 15, 2022, we informed you of the risk faced by French organizations using the services of the Russian ship « Shtandart ».

We would like to point out to you that Mr. Michel Balique, President of « Les Amis des Grands Voiliers – Sail Training Association France », acting as the commercial agent of « Shtandart », is mistaken when he tells you that the sanctions only concern the ships belonging to the oligarchs and to the Russian state, or even being military ships. He sticks to the measures taken before the end of March 2022. That is before the evidences of the crimes in Bucha, Irpin, Mariupol, etc.

Since April 8, 2022, Regulation (EU) No 833/2014 has been updated by Article 3ea, http://data.europa.eu/eli/reg/2014/833/2022-10-07, in application of the 5th package of sanctions, https://www.consilium.europa.eu/en/press/press-releases/2022/04/08/eu-adopts-fifth-round-of-sanctions-against-russia-over-its-military-aggression-against-ukraine/

1. It shall be prohibited to provide access, after 16 April 2022, to ports and, after 29 July 2022, to locks in the territory of the Union, to any vessel registered under the flag of Russia, with the exception of access to locks for the purpose of leaving the territory of the Union.

It is true that until recently, in France, cases of circumvention of sanctions were observed concerning the Russian ship « Shtandart ». This practice of the fait accompli cannot set a precedent. Indeed, on 28 November 2022, the Council unanimously adopted a decision to add the violation of restrictive measures to the list of ‘EU crimes’ included in the Article 83(1) of the Treaty on the Functioning of the EU. In this article, violation of sanctions will join: « terrorism, trafficking in human beings and sexual exploitation of women and children, illicit drug trafficking, illicit arms trafficking, money laundering, corruption, counterfeiting of means of payment, computer crime and organised crime » https://www.consilium.europa.eu/en/press/press-releases/2022/11/28/sanctions-council-adds-the-violation-of-restrictive-measures-to-the-list-of-eu-crimes/

Unable to reach you by your organization’s phone number, which does not seem to be working today, we would like to inform you of the following.

We have learned that you plan to use the services of the Russian frigate « Shtandart » for your next « Gulf of Morbihan Week » event to be held from May 15 to 21, 2023. We believe this is an untimely decision and that is financially risky. Indeed, we take the liberty of informing you that « Shtandart » falls within the scope of the 5th package of sanctions voted unanimously by the Member States of the European Union, on April 8, 2022,. Хочемо нагадати вам, що пан Мішель Балік, президент асоціації « Амі ди Гран Вуальє » (Amis des Grands Voiliers), який виступає як комерційний агент « Штандарту », помиляється, коли каже, що санкції стосуються тільки суден що належать олігархам або російській державі, і навіть воєнних суден. Він спирається на заходи, які були чинними на кінець березня 2022 року. Тобто до того, як стало відомо про злочини в Бучі, Ірпені, Маріуполі тощо.

Це правда, що до останнього часу у Франції спостерігались випадки обходу санкцій стосовно судна « Штандарт ». Ця практика доведеного факту не може служити прецедентним правом. Слід зазначити, що 28 листопада 2022 року, Рада Європейського Союзу одностайно ухвалила рішення, яке додає порушення санкцій до списку кримінальних правопорушень, що фігурують в Договорі про функціонування Європейського Союзу (стаття 83, параграф 1). Таким чином, нам здається більш доцільним для заходу « Семен дю Гольф де Морбіан » (Fr) дочекатися кінця війни в Україні, перш ніж користатися послугами російського судна « Штандарт ». Якщо це судно не бажає повертатися в Росію, воно може вже зараз цілком легально відвідувати численні морські країни, які не вживають санкцій.

Dans l’impossibilité de vous joindre par le numéro de votre organisation, qui ne semble pas fonctionner aujourd’hui, nous vous faisons part des éléments suivants.

Nous avons appris que vous prévoyez de faire appel aux services de la frégate russe Shtandart pour votre prochain événement « La (censuré) » devant se tenir du 15 au 21 mai 2023. Nous pensons qu’il s’agit d’une décision inopportune et financièrement risquée. En effet, nous nous permettons de vous signaler que le Shtandart entre dans le champ du 5e paquet de sanctions voté, le 8 avril 2022, à l’unanimité des Etats membres de l’Union Européenne. Ce texte prévoit :

-une interdiction de donner accès aux ports de l’UE aux navires immatriculés sous pavillon russe. Des dérogations sont accordées pour les produits agricoles et alimentaires, l’aide humanitaire et l’énergie.

Vous pouvez observer que, contrairement à ce qu’affirment Michel Balique, président de l’Association des « Amis des Grands Voiliers », Jean-François Fountaine, Maire de La Rochelle, et Nicolas Basselier, préfet de Charente-Maritime, le cinquième volet de sanctions ne concerne pas que « certaines catégories de navires », voire seulement les navires des « oligarques » ou ceux de « l’Etat russe ».

Notre collectif a manifesté le 11 décembre 2022 à La Rochelle pour demander la fin de la présence illégale du navire russe dans ce port et pour obtenir l’application effective du cinquième volet des sanctions. Avant même l’adoption des sanctions, Fabrice Loher, maire de Lorient, a décidé que le Shtandart ne serait pas présent au festival « Lorient Océans », car « on ne connaît pas la nature de ses liens avec l’Etat russe ». Nous y reviendrons. Depuis la mise en place du 5eme volet des sanctions, la municipalité de Bordeaux a annulé la participation du navire au festival « Bordeaux Fête Le vin », alors que la prestation du navire russe avait déjà fait l’objet d’un règlement financier. Il en a probablement été de même en ce qui concerne « Escales à Sète », pour laquelle l’interdiction a été émise par le préfet de l’Hérault.

L’annulation de la participation du Shtandart à la « Ruta Iacobus Maris » de Vigo a été prononcée la veille de son arrivée dans ce port à la suite d’un courrier adressé à différentes autorités, dont la Junta de Galicia, par une quarantaine d’organisations représentatives de la diaspora ukrainienne en Espagne et en France, à la suite des révélations « d’El Faro de Vigo » https://galego.farodevigo.es/gran-vigo/2022/07/10/fragata-rusa-capea-sanciones-dirige-68161989.amp.html (Es) et à la suite d’une manifestation de la communauté ukrainienne de Vigo. En conséquence de quoi, l’escale à la Corogne a elle aussi été annulée. Le sort du Shtandart, en Espagne, a été scellé par une tribune que nous avons fait paraître dans « Galici@Press » https://www.galiciapress.es/articulo/opinion/2022-07-31/3843303-fabula-anti-putin-permitio-fragata-rusa-shtandart-atracar-galicia (Es).

Aujourd’hui, seuls quelques ports français en Europe sont dans l’illégalité en ce qui concerne l’application des sanctions portant sur les navires russes, dont La Rochelle, où les réseaux d’influence russes sont solidement implantés, au sein des autorités locales et départementales ainsi que dans la presse régionale.

A ce titre, nous attirons votre attention  sur la « fable du Shtandart», qui vise à tromper l’opinion publique française. En consultant des sources russes, nous avons déterminé que le Shtandart est un yacht russe privé appartenant, pour 60%, à Vladimir Martus, son capitaine, via une entité écran nommée « Shtandart Project ». Nous avons mis au jour le fait que le Shtandart et son capitaine entretiennent des liens étroits avec le pouvoir russe. À titre d’exemple, nous mentionnerons une mission de représentation diplomatique tenue par le Shtandart, en octobre 2021, sous le haut patronage de Vladimir Poutine. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). Il s’agissait de la célébration du 250e anniversaire de la victoire navale de Tchesmé en mer Égée. L’événement s’est déroulé en présence des autorités grecques et de l’ambassadeur plénipotentiaire de Russie en Grèce.

En conséquence, Vladimir Martus n’est pas ce qu’il prétend être, c’est-à-dire « un opposant politique de longue date au régime de Poutine ». De même, son affirmation comme quoi il « n’a pas pu revoir son pays depuis de nombreuses années » est inexacte. En ce sens, nous soulignons que le propriétaire du Shtandart est retourné à son domicile de Saint-Pétersbourg entre le début janvier 2022 et la mi-février 2022 https://vk.com/wall354135_3640 (Ru). Enfin, la qualification de « voilier école », que les autorités rochelaises lui attribuent, de façon très contestable, ne change rien à cette affaire. Il n’existe pas d’exception au cinquième volet des sanctions pour les navires-écoles, pas plus qu’il n’en existerait pour les prétentions, même si certaines étaient avérées, de ce qu’il convient d’appeler « la fable du Shtandart ».

Dear Madam,

Unable to reach you by your organization’s phone number, which does not seem to be working today, we would like to inform you of the following.

We have learned that you plan to use the services of the Russian frigate « Shtandart » for your next « Gulf of Morbihan Week » event to be held from May 15 to 21, 2023. We believe this is an untimely decision and that is financially risky. Indeed, we take the liberty of informing you that « Shtandart » falls within the scope of the 5th package of sanctions voted unanimously by the Member States of the European Union, on April 8, 2022,. This text provides:

…a ban on giving access to EU ports to vessels registered under the Russian flag. Exemptions are granted for agricultural and food products, humanitarian aid and energy…

You can observe that, contrary to what Michel Balique, president of the Association of « Friends of Tall Ships », Jean-François Fountaine, Mayor of La Rochelle, and Nicolas Basselier, prefect of Charente-Maritime, claim, the fifth section of sanctions does not concern « only certain categories of vessels », or even only the vessels of the « oligarchs » or those of the « Russian State ».

Our committee demonstrated on December 11, 2022 in La Rochelle to demand an end to the illegal presence of the Russian ship in this port and to obtain the effective application of the fifth round the sanctions. Even before the adoption of sanctions against Russian ships, Fabrice Loher, mayor of Lorient, decided that the « Shtandart » ship would not be present at the “Lorient Océans” festival, because “we do not know the nature of its links with the Russian state”. We will come back to it. Since the implementation of the 5th package of sanctions, the municipality of Bordeaux has canceled the participation of the ship in the festival « Bordeaux Fête Le vin », while the service of the Russian ship had already been the subject of a financial settlement. It was probably the same with regard to “Escales à Sète”, for which the ban was issued by the prefect of Herault.

The cancellation of the participation of the « Shtandart » in the « Ruta Iacobus Maris » of Vigo was pronounced the day before its arrival in this port following a letter addressed to various authorities, including the Junta de Galicia, by about forty representative organizations of the Ukrainian diaspora in Spain and in France, following the revelations of « El Faro de Vigo » https://bit.ly/shtandart-el-faro-vigo-en and following a demonstration by the Ukrainian community in Vigo. As a result, the stopover in La Coruña was also cancelled. Today, only a few French ports in Europe are illegal with regard to the application of sanctions relating to Russian ships, including La Rochelle, where Russian influence networks are firmly established, within local and departmental authorities as well as in the regional press.

As such, we draw your attention to the « Shtandart’s tale », which aims to deceive French public opinion. By checking Russian sources, we have determined that « Shtandart » is a private Russian yacht owned, for 60%, by Vladimir Martus, its captain, through a screen entity called “Shtandart Project”. We have brought to light the fact that the « Shtandart » and its captain maintain close ties with Russian authorities. By way of example, we will mention a diplomatic representation mission held by the « Shtandart », in October 2021, under the high patronage of Vladimir Putin. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). It was the celebration of the 250th anniversary of the naval victory of Çeşme in the Aegean Sea. The event took place in the presence of the Greek authorities and the Plenipotentiary Ambassador of Russia to Greece.

As a result, Vladimir Martus is not what he claims to be, which is « a long-time political opponent of Putin’s regime ». Likewise, his assertion that he « has not been able to see his country again for many years » is inaccurate. In this sense, we point out that the owner of the « Shtandart » returned to his home in St. Petersburg between the beginning of January 2022 and mid-February 2022 https://vk.com/wall354135_3640 (Ru). Finally, the qualification of “training ship”, which the authorities of La Rochelle attribute to it, in a very questionable way, does not change anything in this affair. There is no exception to the fifth part of the sanctions for training ships, any more than there would be for the claims, even if some were proven, of what should be called « the Shtandart’s tale”.

Our committee would like to receive a response from your services within a week. In the meantime, we remain at your disposal to provide you with the verified information we have about the Russian ship, Shtandart, and the Russian citizen, Vladimir Martus.

Chère Madame,

Le 15 décembre 2022, nous vous faisions part du risque que représente, pour des organisations, le fait d’avoir recours aux prestations du navire russe « Shtandart ».

Nous souhaitons vous préciser que M. Michel Balique, Président de l’association des « Amis des Grands Voiliers », se faisant l’agent commercial du « Shtandart », se trompe quand il vous dit que les sanctions ne concernent que les navires des oligarques ou de l’Etat russe, voire les navires militaires. Il s’en tient aux mesures prises avant la fin mars 2022. C’est-à-dire avant les révélations concernant les crimes de Boutcha, Irpin, Marioupol, etc.

Depuis le 8 avril 2022, le Règlement (UE) N° 833/2014 a été mis à jour par l’Article 3 sexies bis, https://eur-lex.europa.eu/legal-content/FR/TXT/?uri=CELEX:02014R0833-20221007, en application du 5e volet des sanctions. https://www.consilium.europa.eu/fr/press/press-releases/2022/04/08/eu-adopts-fifth-round-of-sanctions-against-russia-over-its-military-aggression-against-ukraine/

1.  Il est interdit de donner accès, après le 16 avril 2022, aux ports et, après le 29 juillet 2022, aux écluses situées sur le territoire de l’Union à tout navire immatriculé sous pavillon russe, à l’exception de l’accès aux écluses pour quitter le territoire de l’Union

Il est vrai que jusqu’à une date récente, en France, des cas de contournement des sanctions ont été observés concernant le « Shtandart ». Cette pratique du fait accompli ne peut pas faire jurisprudence. En effet, le 28 novembre 2022, le Conseil a adopté à l’unanimité une décision visant à ajouter la violation des sanctions à la liste des domaines de criminalité figurant dans le traité sur le fonctionnement de l’Union européenne (article 83, paragraphe 1). Le contournement des sanctions vient rejoindre « le terrorisme, la traite des êtres humains et l’exploitation sexuelle des femmes et des enfants, le trafic illicite de drogues, le trafic illicite d’armes, le blanchiment d’argent, la corruption, la contrefaçon de moyens de paiement, la criminalité informatique et la criminalité organisée ».

Il nous semble donc judicieux, pour « La Semaine du Golfe du Morbihan« , d’attendre la fin de la guerre en Ukraine avant d’employer les services du navire russe « Shtandart ». D’ici là, si ce dernier ne souhaite pas retourner en Russie, il peut visiter, en toute légalité, les très nombreux pays maritimes qui n’appliquent pas de sanctions.

Depuis la mise en place du 5eme volet des sanctions, la municipalité de Bordeaux a annulé la participation du navire au festival « Bordeaux Fête Le vin », alors que la prestation du navire russe avait déjà fait l’objet d’un règlement financier. Il en a probablement été de même en ce qui concerne « Escales à Sète », pour laquelle l’interdiction a été émise par le préfet de l’Héraut.

L’annulation de la participation du Shtandart à la « Ruta Iacobus Maris » de Vigo a été prononcée la veille de son arrivée dans ce port à la suite d’un courrier adressé à différentes autorités, dont la Junta de Galicia, par une quarantaine d’organisations représentatives de la diaspora ukrainienne en Espagne et en France, à la suite des révélations « d’El Faro de Vigo » https://galego.farodevigo.es/gran-vigo/2022/07/10/fragata-rusa-capea-sanciones-dirige-68161989.amp.html (Es) et à la suite d’une manifestation de la communauté ukrainienne de Vigo. En conséquence de quoi, l’escale à la Corogne a elle aussi été annulée. Le sort du Shtandart, en Espagne, a été scellé par une tribune que nous avons fait paraître dans « Galici@Press » https://www.galiciapress.es/articulo/opinion/2022-07-31/3843303-fabula-anti-putin-permitio-fragata-rusa-shtandart-atracar-galicia (Es).

Aujourd’hui, seuls quelques ports français en Europe sont dans l’illégalité en ce qui concerne l’application des sanctions portant sur les navires russes, dont La Rochelle, où les réseaux d’influence russes sont solidement implantés, au sein des autorités locales et départementales ainsi que dans la presse régionale.

A ce titre, nous attirons votre attention  sur la « fable du Shtandart», qui vise à tromper l’opinion publique française. En consultant des sources russes, nous avons déterminé que le Shtandart est un yacht russe privé appartenant, pour 60%, à Vladimir Martus, son capitaine, via une entité écran nommée « Shtandart Project ». Nous avons mis au jour le fait que le Shtandart et son capitaine entretiennent des liens étroits avec le pouvoir russe. À titre d’exemple, nous mentionnerons une mission de représentation diplomatique tenue par le Shtandart, en octobre 2021, sous le haut patronage de Vladimir Poutine. https://mio.com.gr/publikatsii/eksklyuziv/pod-andreevskim-flagom-k-grecheskim-ostrovam (Ru). Il s’agissait de la célébration du 250e anniversaire de la victoire navale de Tchesmé en mer Égée. L’événement s’est déroulé en présence des autorités grecques et de l’ambassadeur plénipotentiaire de Russie en Grèce.

En conséquence, Vladimir Martus n’est pas ce qu’il prétend être, c’est-à-dire « un opposant politique de longue date au régime de Poutine ». De même, son affirmation comme quoi il « n’a pas pu revoir son pays depuis de nombreuses années » est inexacte. En ce sens, nous soulignons que le propriétaire du Shtandart est retourné à son domicile de Saint-Pétersbourg entre le début janvier 2022 et la mi-février 2022 https://vk.com/wall354135_3640 (Ru). Enfin, la qualification de « voilier école », que les autorités rochelaises lui attribuent, de façon très contestable, ne change rien à cette affaire. Il n’existe pas d’exception au cinquième volet des sanctions pour les navires-écoles, pas plus qu’il n’en existerait pour les prétentions, même si certaines étaient avérées, de ce qu’il convient d’appeler « la fable du Shtandart ».

The French media space is literally saturated and corrupted by the propaganda of the Russian ship Shtandart as well as by a fallacious rewriting of European sanctions. Although the tools and resources have been developed to counter this disinformation carried by powerful intermediaries, the truth will only come to light through the determined and collective action of #NoShtandartInEurope activists. This article determines the modus operandi of their endeavour.

The digital sphere is drowned out by pro-Shtandart propaganda

In France, the Russian frigate Shtandart enjoys massive audio, written and video press coverage. This press takes up, without analysis, an « anti-Putin » tale and a misleading presentation of European sanctions drawn up by Vladmir Martus, the ship’s captain, by pro-Russian networks, by maritime heritage enthusiasts, by partners of nautical events (including press) using the paid services of the Russian boat, by the municipality of La Rochelle and by the prefecture of Charente-Maritime. These « main-stream » media are much better indexed than our private publications. As a result, the image of Shtandart, although fake, is saturating the digital space. The demonstration of December 11, 2022, in La Rochelle, gave us legitimacy and a beginning of visibility. But our debunking always comes up against a “glass ceiling”. At most, we are barely beginning to show that the privileges granted to Shtandart are not unanimously accepted.

Response tools are ready and waiting for you.

We must try to exist in the media sphere so that our protest becomes visible.

  • Facebook is a tool for mobilization and coordination, which is why we created the open group “No Shtandart In Europe”, but Facebook publications are rarely showing in Google search results. In addition, finding a somewhat old publication is almost impossible.
  • The question of creating a website arose. Unfortunately, it would have taken time to be correctly indexed, therefore visible. I preferred to create a “sub-blog” on my personal web site, which is already quite aged and has a good SEO (Search Engine Optimization).
  • On Twitter, I regularly post about Shtandart. The reactions are encouraging. Again, I use my personal account, which has more than 1100 followers. Creating an audience of this size would have taken a considerable amount of time.
  • We opened an Instagram account, because Shtandart is very present on this social media, where it performs a lot of its commercial promotion. Our goal is to come and insert ourselves in the search results concerning the Russian boat. Thank you to the first 40 followers. However, the account still needs to strengthen to be visible.
  • Eventually, we launched a Pinterest account in order to occupy the image search results.

Your involvement, even slight, is crucial in this digital campaign.

As soon as you talk about Shtandart on Facebook, Twitter or Instagram, remember to use at least the hashtags #Shtandart, #Штандарт, #noshtandartineurope. At the same time, you can help, in a decisive way, to promote the committee content to social media and search engines. It will only take you a short time. However, remember that we gain nothing by arguing. We would only make our adversary more visible. The effort should be focused on promoting the content of « No Shtandart ». Our approach is that of opposite content burial, not that of confrontation.

  • Instagram: subscribe to the account @noshtandartineurope. Again, comment and like, when you can. Invite your friends.
  • Facebook: join the group No Shtandart In Europe – Public. If necessary, like, comment and share, it will only be better. Invite your friends.
  • On line articles: we already have thirty-one articles in French, Shtandart-Fr, sixteen articles in English, Shtandart-En, eight articles in Spanish, Shtandart-Es, and seven articles in Ukrainian, Shtandart-Ukr. The number of shares is crucial for SEO. If you can comment, on the website, at the bottom of the articles, this is also very important for Google. Eventually, if you know media that would like to publish one or more of our articles, this would be a great help in sharing our information.

L’espace médiatique français est littéralement saturé et corrompu par la propagande du navire russe Shtandart ainsi que par une réécriture fallacieuse des sanctions européennes. Bien que les outils et les ressources aient été développés afin de contrer cette désinformation portée par de puissants relais, la vérité n’arrivera à se faire connaître que par l’action déterminée des activistes du collectif #NoShtandartInEurope. Le présent article en détermine le modus operandi.

La sphère digitale est noyée par la propagande pro-Shtandart

En France, la frégate russe Shtandart jouit d’une couverture de presse audio, écrite et vidéo massive. Cette presse reprend, sans analyse, une fable « anti-poutine » et une présentation mensongère des sanctions européennes élaborées par Vladmir Martus le capitaine du navire, par les réseaux pro-russes, par les passionnés du patrimoine maritime, par les partenaires des événements nautiques (dont la presse) faisant appel aux prestations rémunérées du bateau russe, par la municipalité de La Rochelle et par la préfecture d Charente-Maritime. Ces médias « main-stream » sont bien mieux référencés que nos publications privées. En conséquence, l’image du Shtandart, bien que fausse, a saturé l’espace numérique. La manifestation du 11 décembre 2022, à La Rochelle, nous ait donné une légitimité et un début de visibilité. Mais notre démystification (debunking) se heurte toujours à un « plafond de verre ». Tout au plus, commence-t-on, à peine, à reconnaître, que les passe-droits accordés au Shtandart ne font pas une complète unanimité.

Les outils de réponse sont prêts et n’attendent que vous.

Il nous faut tenter d’exister dans la sphère médiatique afin que notre contestation devienne visible.

  • Enfin, nous avons lancé un compte Pinterest afin de bien occuper les résultats de recherche image.

Votre implication, même légère, est cruciale dans cette campagne digitale.

Dès que vous parlez du Shtandart sur Facebook, Twitter et Instagram, pensez, au minimum, à utiliser les hashtags, #Shtandart, #Штандарт, #noshtandartineurope. Parallèlement, vous pouvez aider, de façon décisive, à valoriser le contenu de notre collectif auprès des réseaux sociaux et des moteurs de recherche. Cela ne vous prendra que peu de temps. Néanmoins, souvenez-vous qu’on ne gagne rien en polémiquant. On ne fait que rendre notre adversaire plus visible. L’effort doit se concentrer sur la promotion du contenu « No Shtandart ». Notre démarche est celle de l’enfouissement, pas celle de l’affrontement.

Without knowing how, we imagined that the mayor and the prefect had solid arguments in their files. Discovering them, for the first time in the Sud Ouest newspaper, we were stunned. Our committee, #NoShtandartInEurope, didn’t expect so much. On both sides, they are in escheat and fiction, as for a European text, which is accessible, online, by all.

Dimanche 11 décembre, l’association Ukraine-Atlantique et le collectif No Shtandart in Europe ont manifesté, à La Rochelle, contre la présence de la frégate russe stationnée dans le port. Les manifestants dénoncent un accueil illégal.

Alors que l’Europe a fermé ses portes aux navires russes, l’association Ukraine-Atlantique et le collectif No Shtandart in Europe ont manifesté, dimanche 11 décembre, contre la présence de la frégate russe dans le port de La Rochelle. En clair, association et collectif demandaient à la municipalité de La Rochelle et à la Préfecture de Charente-Maritime de se conformer à la légalité. Les 80 manifestants réunis ont dénoncé « l’accueil illégal« .

Un navire école bien connu à La Rochelle

Bien connue des Rochelais, puisqu’elle vient régulièrement dans le port depuis 2013, la présence, dans le bassin des Chalutiers, de ce navire-école russe n’est pas forcément acceptée par une partie de la communauté ukrainienne.

Association Ukraine-Atlantique

Depuis le 24 février, date du début de l’offensive russe en Ukraine, la frégate n’est plus aussi bien accueillie qu’elle l’était auparavant. D’autant que l’Union européenne a acté, en avril, la fermeture des ports européens aux navires russes. Pour l’association Ukraine-Atlantique, « le viol des sanctions avec les encouragements du maire de La Rochelle et du préfet de Charente-Maritime n’est plus tenable.« 

Pour la mairie de La Rochelle, l’accueil est parfaitement légal

La mairie de la Rochelle par la voix de la première adjointe en charge des sports et du nautisme, il n’y a aucune raison de refuser l’entrée au port à ce bateau.

C’est un navire école, ce n’est pas un bateau de guerre, ni de commerce ou appartenant à un oligarque. C’est une réplique de la frégate de Pierre le Grand très apprécié des rochelais.

« Oui, le bateau bat pavillon russe parce qu’il est Russe et puis de toute façon, il ne peut pas changer de pavillon. Depuis le début de la guerre en Ukraine, l’Europe a interdit aux bateaux russes de changer de pavillon pour éviter justement qu’ils en profitent pour naviguer dans nos eaux. », explique-t-elle. « De plus, le capitaine est Ukrainien par son père et Russe par sa mère » poursuit-elle, et, « c’est un opposant à Poutine qui a quitté Saint-Pétersbourg avec le Shtandart en 2009 parce qu’il n’était plus d’accord avec la politique de Poutine » ajoute-t-elle.

Enfin, l’adjointe précise que toutes les vérifications ont été faites auprès de la préfecture, des douanes et du ministère des Affaires étrangères, « ce bateau a parfaitement le droit d’être accueilli. »

Les associations opposées à l’accueil de ce bateau ont cependant prévu de nouvelles manifestations.
